ประกาศคณะกรรมการพิจารณาคัดกรองผู้ได้รับการคุ้มครอง เรื่อง กำหนดการยื่นอุทธรณ์และการพิจารณาอุทธรณ์ โดยที่เป็นการสมควรกาหนดการยื่นอุทธรณ์และการพิจารณาอุทธรณ์ ตามระเบียบสานัก นายกรัฐมนตรี ว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศ อันเป็นภูมิลำเนาได้ พ.ศ. 2562 อาศัยอำนาจตามความในข้อ 9 (1) และข้อ 17 ของระเบียบสำนักนายกรัฐมนตรี ว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็น ภูมิลาเนาได้ พ.ศ . 2562 คณะกรรมการพิจารณาคัดกรองผู้ได้รับการคุ้มครอง จึงออกประกาศไว้ ดังต่อไปนี้ ข้อ 1 การดาเนินการพิจารณาอุทธรณ์ต้องแล้วเสร็จภายในเก้าสิบวัน หากมีเหตุ จาเป็น ให้ขยายระยะเวลาดาเนินการได้อีกไม่เกินสามสิบวัน 1.1 ผลการพิจารณาอุทธรณ์ของคณะกรรมการหรือคณะอนุกรรมการพิจารณาอุทธรณ์ ให้เป็นที่สุด 1. 2 กรณีมีมติให้ผู้ยื่นอุทธรณ์มีสิทธิยื่นคำขอเป็นผู้ได้รับการคุ้มครองแล้ว ให้แจ้งผล การพิจารณาอุทธรณ์ให้คนต่างด้าวทราบ (ตามแบบ คก.4) และให้ดาเนินการยื่นคาขอเป็นผู้ได้รับ การคุ้มครองต่อคณะกรรมการตามแบบที่คณะกรรมการประกาศกำหนด (ตามแบบ คก.5) ต่อไป 1. 3 กรณีมีมติให้ยกคำร้องอุทธรณ์ให้แจ้งผลการพิจารณาอุทธรณ์ให้คนต่างด้าวทราบ (ตามแบบ คก.4) และให้พนักงานเจ้าหน้าที่ดำเนินการตามกฎหมายว่าด้วยคนเข้าเมืองหรือกฎหมายอื่น ที่เกี่ยวข้อง ต่อไป 1. 4 เมื่อครบกาหนดเวลาอุทธรณ์และไม่มีการอุทธรณ์ภายในเวลากาหนด ให้ดาเนินการ กับคนต่างด้าวนั้นตามกฎหมายว่าด้วยคนเข้าเมืองหรือกฎหมายอื่นที่เกี่ยวข้องต่อไ ป ข้อ 2 สถานที่ และวัน เวลา ที่ยื่นคำร้องอุทธรณ์ขอรับสิทธิเป็นผู้ได้รับการคุ้มครอง 2. 1 กองกำกับการ 4 กองบังคับการสืบสวนสอบสวน สำนักงานตรวจคนเข้าเมือง และในวัน เวลาราชการ 2. 2 ที่ทำการตรวจคนเข้าเมืองที่คนต่างด้าวถูกกักตัว ข้อ 3 แบบแจ้งผลการพิจารณาคาร้องขอรับสิทธิเป็นผู้ได้รับการคุ้มครอง ตามแบบ (คก.2) แนบท้ายประกาศนี้ ข้อ 4 แบบคำร้องอุทธรณ์ ตามแบบ (คก.3) แนบท้ายประกาศนี้ ้ หนา 31 ่ เลม 140 ตอนพิเศษ 166 ง ราชกิจจานุเบกษา 11 กรกฎาคม 2566
