ประกาศกรมเจ้าท่า ที่ 257 / 25 6 5 เรื่อง แบบบันทึกข้อตกลงเพื่อยอมรับและผูกพันในการปฏิบัติตามข้อกาหนด และเงื่อนไขการตรวจเรือและออกใบสำคัญรับรองตามอนุสัญญาระหว่างประเทศและพิธีสาร ด้วยประมวลข้อบังคับว่าด้วยองค์กรที่ได้รับการยอมรับ ( Code for Recognized Organizations; RO Code ) ขององค์การทางทะเลระหว่างประเทศ ซึ่งออกตามมติคณะกรรมการด้านความปลอดภัยทางทะเล ที่ 349 (92) และมติคณะกรรมการด้านการคุ้มครองสิ่งแวดล้อมทางทะเล ที่ 2 37 (65) และที่แก้ไขเพิ่มเติม ( Resolution MSC . 349 (92) and MEPC . 237 (65) , as amended ) กาหนดพันธกรณีให้รัฐภาคีดาเนินการจัดทาข้อตกลงร่วมกันเป็นลายลักษณ์อักษรระหว่างหน่วยงานรัฐ เจ้าของธงกับองค์กรที่ได้รับการยอมรับในเรื่องการกำหนดและเงื่อนไขสำหรับการตรวจเรือและ ออกใบสาคัญรับรองการตรวจเรือตามที่ได้รับมอบหมายให้สอดคล้องกับอนุสัญญาระหว่างประเทศและ พิธีสารที่เกี่ยวข้อง รวมถึงให้เป็นไปตามมาตรฐานระหว่างประเทศ นั้น อาศัยอานาจตามความในข้อ 5 (3) และข้อ 6 ของประกาศกระทรวงคมนาคม เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขในการดาเนินงานขององค์กรที่ได้รับการยอมรับให้ตรวจเรือและ ออกใบสำคัญรับรองการตรวจเรือ จากกรมเจ้าท่า ลงวันที่ 24 มีนาคม พ.ศ. 2565 อธิบดีกรมเจ้าท่า จึงออกประกาศกรมเจ้าท่า เรื่อง แบบบันทึกข้อตกลงเพื่อยอมรับและผูกพันในการปฏิบัติตามข้อกำหนด และเงื่อนไขการตรวจเรือและออกใบสำคัญรับรองตามอนุสัญญาระหว่างประเทศและพิธีสาร ดังต่อไปนี้ 1 . ให้ยกเลิกประกาศกรมเจ้าท่า ที่ 15/2560 เรื่อง แบบบันทึกข้อตกลงฝ่ายเดียว เพื่อยอมรับและผูกพันในการปฏิบัติตามข้อกาหนดและเงื่อนไขการตรวจเรือและออกใบสาคัญรับรอง ตามอนุสัญญาระหว่างประเทศและพิธีสาร ตามกฎข้อบังคับสำหรับการตรวจเรือ (ฉบับที่ 45) พ.ศ. 2558 ลงวันที่ 30 มกราคม 2560 2 . ให้ใช้แบบบันทึกข้อตกลงเพื่อยอมรับและผูกพันในการปฏิบัติตามข้อกาหนดและเงื่อนไข การตรวจเรือและออกใบสาคัญรับรองตามอนุสัญญาระหว่างประเทศและพิธีสาร ตามภาคผนวกที่แนบท้าย ประกาศฉบับนี้ ประกาศ ณ วันที่ 9 พฤศจิกายน พ.ศ. 256 5 สรพงศ์ ไพฑูรย์พงษ์ รองปลัดกระทรวงคมนาคม รักษาราชการแทน อธิบดีกรมเจ้าท่า ้ หนา 27 ่ เลม 139 ตอนพิเศษ 293 ง ราชกิจจานุเบกษา 16 ธันวาคม 2565

1 . การใช้บังคับ 1.1 ข้อตกลง ฉบับ นี้ทําขึ้นระหว่ํางกรมเจ้ําท่ํา กระทรวงคมนําคม แห่งรําชอําณําจักรไทย ต่อไปนี้จะ เรียกว่ํา “ กรมเจ้ําท่ํา ” กับ … ต่อไปนี้จะเรียกว่ํา “ RO ” ซึ่งเป็นสมําชิกขององค์กรสถําบันจัดชั้นเรือระหว่ําง ประเทศ ( International Association of Classification Societies ; IACS ) และเป็นสถําบันกํารตรวจเรือที่กรม เจ้ําท่ํา มอบหมําย ให้ตรวจเรือและออกใบสําคัญรับรอง 1.2 กรมเจ้ําท่ํา มอบหมําย ให้ RO กระทํากํารในฐํานะตัวแทนของกรมเจ้ําท่ํา โดย เป็นไปตํามหลักกําร ไม่ปฏิบัติต่อเรือของรัฐที่ไม่ได้เป็นภําคีอนุสัญญําที่เป็นคุณกว่ําเรือที่ชักธงประเทศซึ่งได้ให้สัตยําบันอนุสัญญําแล้ว เพื่อปฏิบัติหน้ําที่ในกํารตรวจสภําพเรือระหว่ํางกํารต่อสร้ํางเรือและภํายหลังจํากกํารต่อสร้ํางเรือแล้วเสร็จ ตรวจ รับรองวัสดุ และ มําตรฐํานอุปกรณ์ ตรวจผู้ให้บริกํา ร สถํานีบริกําร และบริษัทบริหําร จัดกํารกองเรือ กําหนด กําร จัดชั้น เรือ หรือดําเนินกํารตรวจอื่นใดที่เกี่ยวกับ เรือที่ชักธงไทย ที่เกี่ยวข้องกับมําตรฐําน ของ องค์กํารทํางทะเลระหว่ําง ประเทศ ( International Maritime Organization ; IMO ) หรือองค์กรสถําบันจัดชั้นเรือระหว่ํางปร ะเ ทศ ( International Association of Classification Societies ; IACS ) รวมถึง ออกใบส ําคัญรับรองตํามข้อก ําหนดของ อนุสัญญําระหว่ํางประเทศและพิธีสํารที่เกี่ยวข้อง 1.3 กรมเจ้ําท่ํามอบหมํายให้ RO ก ําหนดประเภทกํารใช้เรือ ( Type of Ship ) ออกใบสําคัญรับรองตําม กฎหมํายสําหรับกํารตรวจสภําพเรือและกํารรับรองมําตรฐํานภํายใต้ระบบกํารจัดชั้นเรือ ทั้งนี้ ได้มีกํารกําหนด ขอบเขต ในกํารปฏิบัติหน้ําที่ ไว้ในภําคผนวก 1 ของข้อตกลงฉบับนี้ รวมถึงกํารออกใบสําคัญรับรองในรูปแบบ อิเล็กทรอนิกส์ ( e - certificate) ที่ สอดคล้องกับ บทบัญญัติ ของ กฎหมํายไทย รวมถึง ข้อก ําหนดของอนุสัญญําระหว่ําง ประเทศและพิธีสํารที่เกี่ยวข้อง 2. วัตถุประสงค์ ข้อตกลงฉบับนี้มี วัตถุประสงค์เพื่อกําหนดนิยําม ขอบเขต ในกําร ปฏิบัติ หน้ําที่ ข้อกําหนดและเงื่อนไข สําหรับ กํารมอบหมําย หน้ําที่ ตํามขอบเขตซึ่งกระทํากํารในนํามของกรมเจ้ําท่ํา ในกําร กํารออกใบสําคัญรับรองตําม กฎหมําย และ ข้อบังคับต่ําง ๆ รวมถึง กํารให้ คําจํากัดควํามส ําหรับ ควํามร่วมมือ เพื่อ กํารสร้ําง มําตรฐํานควําม ปลอดภัยและ คุ้มครอง รักษําสิ่งแวดล้อมทํางทะเ ล

TRANSLATION Memo r andum of Agreement for Recognized Organ i zation s t o C omply with the R equireme n ts and C onditions on C onducting S h i p S urvey and I ssuance of S urvey C ertificates in accordance w ith the Internat i onal Conv e n t i ons and Protocols 1. Application 1.1 This agreement has been settled between the Marine Department , Ministry of Transport of the Kingdom of Thailand) hereinafter called “ Marine Department ” , and…hereinafter called “ RO ” which shall be a member of the International Association of Classification Societies (IACS) a nd a ship inspection institute authorizing by Marine Department to conduct survey and iss ue certificate. 1.2 Marine Department accepts RO to perform, under no more favorable treatment basis, as a representative of Marine Department in the duties of ship inspections during and thereafter of shipbuilding, and ship classification i ncluding approval of material , equipment , service provider , service station , s hip m anagement , determin e ship notation and other relevant ship flying Thai flag which are related to standard s of International Maritime Organization; IMO and International Association of Classification Societies; IACS i ncluding issuance certificate in compliance with requirements of International Conventions and I nstruments . 1.3 Marine Department authorized RO to d etermine type of ship and issue statutory certificates of survey under the ship statutory certification regimes and classification standards. The RO shall be only authorized to the scope define d in Annex I of this agreement. The RO may issu e an electronic certificate ( e - certificate ) which is in compliance with Thai law , International Conventions and I nstruments. 2. Purposes The purpose of t his Memorandum is t o define the scope of service performance, terms, and conditions of delegation of a u thority t o issue statutory certifica t ion, v arious regulations, and t o define the mut u al cooperation in t he aspects of sa f ety standard and marine e n vironmental protection.

3. เงื่อนไขที่กำหนดเป็นการทั่วไป 3.1 กําร ดําเนินกํารตรวจ เรือ และ ออกใบสําคัญรับรองตํามกฎหมําย ประกอบด้วย กํารประเมินสภําพเรือที่ จดทะเบียน เป็น เรือไทยเพื่อ พิจํารณํา ว่ําเรือ หรือบริษัท ได้ดําเนินกํารให้เป็นไปตําม ข้อกําหนด และหลักเกณฑ์ของ อนุสัญญําระหว่ํางประเทศและกฎ หมําย ของประเทศไทย (ซึ่งต่อไปนี้จะเรียกว่ํา “ ตรําสํารที่ใช้บังคับ ”) รํายละเอียด ปรํากฏตําม เอกสํารใน ภําคผนวก 1 3.2 RO ตกลงให้ควํามร่วมมือกับเจ้ําหน้ําที่ตรวจควบคุมเรือในเมืองท่ําเพื่ออํานวยควํามสะดวกในกํารปรับปรุง แก้ไขข้อบกพร่องที่ได้รับรํายงํานซึ่ง เกี่ยวข้องกับกําร ดําเนินกํารตรวจ เรือ และ ออกใบส ําคัญรับรอง ในนํามของ กรมเจ้ําท่ํา ตํามกฎหมํายที่กําหนดใน ข้อตกลงฉบับนี้ และพร้อมปฏิบัติตําม ข้อ แนะนํา หรือคําสั่ง จํากกรมเจ้ําท่ํา และ ต้อง รํายงํานให้กรมเจ้ําท่ําทรําบ ในโอกําสแรก 3.3 กําร ดําเนินกํารของ RO เพื่อ กํารออกใบสําคัญรับรองตํามกฎหมํายถือเสมือนหนึ่งว่ําเป็นกํารออกใบสําคัญ รับรองตํามกฎหมํายที่ได้จัดทําโดยกรมเจ้ําท่ํา ในฐํานะรัฐเจ้ําของธง ซึ่ง RO ต้อง ดําเนินกํารให้เป็นไปโดยสอดคล้อง กับบทบัญญัติแห่งประมวลข้อบังคับว่ําด้วยองค์กรที่ได้รับกํารยอมรับ ( Code for Recognized Organizatio n ; RO Code ) ตํามมติคณะกรรมกํารด้ํานควํามปลอดภัยทํางทะเล ที่ 349 ( 92 ) และมติคณะกรรมกําร ด้ํานกําร คุ้มครอง สิ่งแวดล้อมทํางทะเล ที่ 237 ( 65 ) และที่แก้ไขเพิ่มเติม ( Resolution MSC. 349 (92) and MEPC. 237 (65) as amended) ขององค์กํารทํางทะเลระหว่ํางประเทศ ( International Maritime Organization; IMO) 3.4 กํารพิจํารณํา มอบหมํายให้ ดําเนินกําร อื่น ใด นอ กเหนือไปจําก ขอบเขต ในกํารปฏิบัติหน้ําที่ตําม ที่กําหนดไว้ ใน เอกสํารตําม ภําคผนวก 1 ของข้อตกลง ฉบับ นี้ ให้ ตกลงร่วมกันเป็นรําย กรณี ไป 3.5 RO ต้องหลีกเลี่ยงกํารกระทํา อันใด ที่มีผลผูกพันซึ่งอําจก่อให้เกิดกํารขัดกันแห่งผลประโยชน์ 3.6 RO ต้อง ปฏิบัติหน้ําที่ตําม ที่ได้รับมอบหมําย เพื่อกํารตรวจเรือและให้กํารรับรองแก่เรือ โดย ต้องใช้ เจ้ําหน้ําที่ ตรวจเรือและผู้ตรวจประเมินที่เป็นเจ้ําหน้ําที่ประจํา ( exclusive surveyors and auditors) กล่ําวคือ เป็นผู้ที่ RO ได้ว่ําจ้ําง เป็นกําร เฉพําะ เท่ํานั้น ซึ่ง ต้องมีคุณสมบัติ ครบถ้วน ผ่ํานกํารฝึกอบรม และได้รับมอบหมํายให้ปฏิบัติหน้ําที่ และ กระท ํา กํารตํามระดับควํามรับผิดชอบที่ ซึ่ง ได้รับมอบหมําย จําก RO

3 . General Conditions 3.1 Issue s tatutory certification and services comprise the assessment of vessels registered as Thai vessels in order to determine the compliance of such vessels /companies with the applicable terms and criteria of international conventions and the laws of Thailand, (hereinafter referred to as “applicable instruments”), details as appeared in Annex I . 3.2 In so far as the certification services covered by this Agreement are concerned, RO agrees to cooperate with Port State Control officers in facilitating the rectification of reported deficiencies on behalf of the Marine Department and shall promptly follow any instructions or orders from Marine Department and report to the Marine Department on the first occasion . 3.3 Services rendered by RO in order to issue statutory certificates shall be accepted as services rendered by the Marine Department , as a Flag Administration, in order to issue statutory certificates provided t hat RO shall maintain compliance with the provisions of RO Code , “ IMO Assembly Resolution MSC. 349 (92) and MEPC. 237 (65) as amended)”. 3.4 Authorization for services outside the scope of Annex I to this Memorandum shall be dealt with as mutually agreed on a case - by - case basis. 3.5 RO shall endeavor to avoid undertaking activities which may result in a conflict of interest. 3.6 RO shall perform survey and certification functions of a statutory nat ure by shall be use exclusive surveyors and auditors, being persons solely employed by RO, duly qualified, trained and authorized to execute all duties and activities incumbent upon their employer, within their level of work responsibility.

4. การดำเนิน การ และ การ มอบหมายหน้าที่ตามขอบเขต ซึ่ง กระทาการ ในนามของกรมเจ้าท่ำ 4.1 การ มอบหมาย และขอบเขต การปฏิบัติหน้าที่ 4.1.1 กรมเจ้ําท่ําได้มอบหมํายให้ RO ปฏิบัติหน้ําที่ เพื่อ ดําเนินกํารตรวจ เรือ และออกใบสําคัญรับรอง ซึ่ง กําหนด ไว้ ใน ข้อตกลงฉบับนี้ และที่ แก้ไข เพิ่มเติม ตลอดจน เอกสํารตําม ภําคผนวก 1 ของข้อตกลงฉบับนี้ ว่ําด้วย “ ตรําสํารที่ใช้บังคับ และตรําสํารที่มีกํารแก้ไขเพิ่มเติม รวมถึงระดับของกําร มอบหมํายให้ปฏิบัติหน้ําที่ ” 4.1.2 ระดับ กํารมอบหมําย ให้ ปฏิบัติหน้ําที่ ระหว่ํางกรมเจ้ําท่ํากับ RO เพื่อ ด ําเนินกํารตรวจ เรือ และ ออกใบส ําคัญ รับรอง ให้เป็นไปตํามที่ก ําหนดไว้ ใน เอกสํารตําม ภําคผนวก 1 ของ ข้อตกลงฉบับนี้ 4.2 หน้าที่ ซึ่งได้มีการมอบหมาย 4.2.1 RO ต้อง ดําเนิน กํารตรวจเรือ ตรวจสอบ หรือตรวจประเมิน เรือ หรือบริษัท ที่ได้จดทะเบียนกับ รําชอําณําจักรไทย โดย ให้เป็นไปตําม ข้อกําหนดของ กฎหมําย สนธิสัญญํา ประมวล ข้อบังคับ และอนุสัญญํา ระหว่ําง ประเท ศ ที่อ้ํางถึงใน เอกสํารตําม ภําคผนวก 1 ของข้อตกลงฉบับนี้ 4.2.2 RO ต้องหํารือกับกรมเจ้ําท่ํา ก่อนมี กําร ระงับใช้ เพิกถอน ยกเลิก หรือ กําร ทําให้ใบ สําคัญ รับรอง สิ้น สภําพ อันเนื่องมําจําก ข้อบกพร่องที่เกิดจําก กําร ตรวจเรือ กําร ตรวจ สอบ หรือกําร ตรวจประเมิน เรือ หรือบริษัท ซึ่ง ไม่เป็นไปตํามที่ระบุใน ข้อ 4.2.1 4.2.3 RO ต้องดําเนิน กําร แก้ไขข้อบกพร่อง ตําม ที่ระบุใน ข้อ 3.2 ของ ข้อตกลงฉบับนี้ ซึ่งถูกตรวจ พบว่ํา มีควําม เกี่ยวข้องกับ กําร ดําเนินกํารตรวจ เรือ และออกใบสําคัญรับรอง เมื่อกรมเจ้ําท่ําได้มีข้อแนะนํา ข้อเสนอแนะ แนวทํางปฏิบัติ หรือค ําสั่ง 4.2.4 RO ต้องเข้ําร่วมช่วยเหลือเรือไทย ซึ่ง ถูกควบคุมโดยเจ้ําหน้ําที่ตรวจควบคุมเรือในเมืองท่ํา เมื่อ ได้รับกําร ร้องขอจําก บริษัท บริหํารจัดกําร กอง เรือ หรือ นําย เรือ ล ําดังกล่ําว ตํามที่กรมเจ้ําท่ําแจ้งให้ RO ด ําเนินกําร 4.3 การ มอบหมาย อื่น ใด ( เพิ่มเติม ) การ มอบหมายอื่นใดนอกเหนือ จาก ที่ระบุใน ข้อ 4 และ ขอบเขต ที่กาหนดใน เอกสํารตําม ภาคผนวก 1 แนบ ท้าย ข้อตกลงฉบับ นี้ ต้องได้รับอนุญาตจากกรมเจ้าท่าเป็นลายลักษณ์อักษร ตามที่ได้ตกลงร่วมกันเป็นรายกรณีไป 4.4 ความสัมพันธ์ ระหว่าง กรมเจ้าท่ากับ RO ใน การดำเนินการ ตามที่ได้รับมอบหมาย และ ดำเนินการ อื่น ใด 4.4.1 RO และ เจ้าหน้าที่ ของ RO ต้องไม่มีส่วนร่วมใน การดาเนินการ ใด ๆ ซึ่ง อาจขัด แย้ง กับ หลัก ความเป็น อิสระ ใน การตัดสิน ใจ และความ สุจริต ในการปฏิบัติ หน้าที่ ใน การ ดําเนินกํารตรวจ เรือ และออกใบสําคัญรับรอง ตาม ที่ ได้รับมอบหมาย นอกจากนี้ RO และ เจ้าหน้าที่ ของ RO ซึ่ง รับผิดชอบในการ ดําเนินกํารตรวจ เรือ และออกใบสําคัญ รับรอง ตามกฎหมาย ต้องไม่ ใช่ ผู้ ออกแบบ ผู้ผลิต ผู้จัดจำหน่าย ผู้ติดตั้ง ผู้ซื้อ เจ้าของ ผู้ใช้ งาน หรือผู้ดูแล บำรุงรักษา สิ่งที่กาหนด ให้ต้องถูกตรวจและออกใบสําคัญรับรอง ตาม ที่ได้รับมอบหมาย รวมถึง ต้องไม่ใช่ ตัวแทน ซึ่ง ได้รับ มอบ อานาจ ของฝ่ายใด และ ต้องไม่ เป็นเจ้าของ ทรัพย์สินของฝ่ายใด ทั้งหมด หรือ แต่บางส่วน ตลอดจน ต้อง ไม่ พึ่งพิง องค์กร เชิงพาณิชย์องค์กรใด องค์กรหนึ่ง อย่างมีนัยสำคัญ เพื่อ หา รายได้ ให้ RO 4.4.2 RO ต้องหลีกเลี่ยง การดำเนินการใด ๆ ซึ่ง อาจก่อให้เกิด การ ขัด กันของ ผลประโยชน์ โดยเฉพาะในส่วน ที่เกี่ยวกับ การ ดําเนินกํารตรวจและออกใบสําคัญรับรอง ตามกฎหมาย ตาม ประมวลข้อบังคับว่าด้วย การบริหารจัดการ ความปลอดภัยระหว่างประเทศ ( ISM Code ) ประมวลข้อบังคับ ว่ําด้วยกํารรักษําควํามปลอดภัยของเรือและท่ําเรือ ระหว่ํางประเทศ (ISPS Code) และ อนุสั ญญําว่ําด้วยแรงงํานทํางทะเล ค.ศ. 2 006 ( MLC 2006 ) 4.5 RO ต้องทาการยืนยันการชาระค่าธรรมเนียม ซึ่งเจ้าของเรือ ได้ ชาระ ให้ แก่กรมเจ้าท่า ก่อนการออก ใบสำคัญรับรองใดๆ

4 . The execution of functions under authorization 4.1 Authorization and scope 4..1.1 This Agreement, as may be amended, including Annex I, “Applicable Instruments, as may be amended, and Degree of Authorization”, states the authorization from M arine D epartment to the RO to perform the Statutory Certification and Services 4.1.2 The d egree to which the M arine D epartment authorizes the RO to perform the Statutory Certification and Services is contained in Annex I of this Agreement. 4.2 Authority Delegated 4.2.1 The RO shall determine by survey, inspection, audit, and assessment the co mpliance of Companies and Vessels registered with Kingdom of Thailand with the mandatory requirements of the Laws, Treaties, Codes, and Conventions referred to Annex I . 4.2.2 The RO shall in consultation with the M arine D epartment before suspension , withdraw, cancel, or invalidate Certificates in accordance with the results of non - conformity to section 4.2.1 . 4.2.3 The RO shall respond corrective actions with regard to the deficiencies prescribed in section 3.2 of this Agreement and found in connectio n with Statutory Certification and Services rendered, in accordance with the M arine D epartment instructions or order s . 4.2.4 Upon request of the ship management or the Master of the Vessel, the RO shall attend a ship detained by PSC following the Marine Department instructions or order . 4.3 Other (additional) authorization Authorization, apart from section 4 abovementioned and the scope of service performance in Annex I to this Agreement , shall be approved by M arine D epartment as mutually agreed in writing on a case - by - case basis. 4.4 Relationship between the Marine Department and RO to conduct statutory certification and services and other related activities 4.4.1 RO and its staff shall not engage in any activities that may conflict with their independence of judgment and integrity in relation to their performance of the Statutory Certification and Services. Furthermore, t he RO and its staff responsible for carryin g out the Statutory Certification and Services shall not be the designer, manufacturer, supplier, installer, purchaser, owner, user, or maintainer of the item (s) subject to the Statutory Certification and Services, nor the authorized representative of any of these parties, nor shall the RO and its staff responsible for carrying out the Statutory Certification and Services be the owner or part - owner of any of these parties including t he RO shall not be substantially dependent on a single commercial enterprise for its revenue. 4.4.2 RO shall avoid undertaking activities that may appear to be, or result in, a conflict of interest, especially with respect to ISM Code, ISPS Code, and MLC 2006 Statutory Certification and Services. 4.5 RO shall verify a fee payment, paid by the S hipowner to the Flag Administration, prior to issue the certificate.

5. หลัก กฎหมาย สำหรับ การปฏิบัติ หน้าที่ตามที่ได้รับมอบหมาย 5.1 ข้อตกลง ฉบับ นี้ จัด ทาขึ้น โดยอาศัยอานาจ ตาม มาตรา 163/1 แห่ง พระราชบัญญัติการเดินเรือใน น่านน้าไทย พ.ศ. 2456 และที่แก้ไขเพิ่มเติม ประกอบกับ ประกาศกระทรวงคมนาคม เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไข ในการประกาศกาหนดสถาบันการตรวจเรือ ให้ตรวจเรือและออกใบสาคัญรับรองการตรวจเรือจาก กรมเจ้าท่า รวมถึงได้พิจารณาให้เป็นไปโดยสอดคล้องกับข้อกาหนดใน ประมวลข้อบังคับว่าด้วยองค์กรที่ได้รับการ ยอมรับ ( RO Code ) และ ข้อกำหนด อื่น ใดซึ่ง กรมเจ้าท่า ได้ประกาศ กำหนด 5.2 การตีความ ตราสารที่ใช้บังคับ ใน กรณีที่มีข้อโต้แย้งหรือข้อพิพาท อันเกิด จาก บทบัญญัติตาม ข้อกา หนดฉบับนี้ ให้กรมเจ้าท่าเป็นผู้ชี้ขาดข้อ โต้แย้ง หรือข้อพิพาท อันเกิดจากบทบัญญัติ ดังกล่าว โดย การ พิจารณา ของกรมเจ้าท่าถือเป็นข้อยุติ 5.2 .1 ตาม ข้อตกลง ฉบับ นี้ คำว่า “การตรวจส ภาพ ” ( inspection) ให้หมาย ความ รวมถึง “การตรวจ” ( survey) เนื่องจากคาดังกล่าวเป็นที่เข้าใจกันทั่วไปใน ภาค อุตสาหกรรมการเดินเรือ 5.2 .2 ตาม ข้อตกลง ฉบับ นี้ คาว่า “ตามกฎหมาย” ( statutory) มีความหมายตาม คานิยาม ที่กาหนดไว้ทั่วไป ในเอกสารขององค์การทางทะเลระหว่างประเทศ 5.2 .3 ตาม ข้อตกลง ฉบับ นี้ คาว่า ” อุปกรณ์บนเรือซึ่งเป็นชนิดที่ได้รับการรับรอง ” ( Type Approval or Approval ) มีความหมายตาม คำนิยาม ที่กาหนดไว้ทั่วไปในเอกสารขององค์การทางทะเลระหว่างประเทศ 5.2 .4 ตาม ข้อตกลง ฉบับ นี้ คำว่า “ผู้ให้บริการ” ( service supplier) เป็นองค์กรหรือบุคคล ธรรมดาซึ่ง ให้บริการในนามของ RO เช่น การตรวจวัด การทดสอบ หรือการบารุงรักษา โดย ผลลัพธ์ที่ได้นั้น เป็นปัจจัย ในการ ตัดสินใจ เพื่อ การ ออกใบสาคัญรับรอง 5.2 .5 ตาม ข้อตกล งฉบับ นี้ เอกสาร คาแถลง หรือหนังสือรับรองการ ปฏิบัติ ตามกฎหมาย รวมถึงเอกสาร รับรองการปฏิบัติตาม กฎหมาย ซึ่ง แสดง ให้เห็น ถึงการปฏิบัติตาม อนุ สัญญา ประมวลข้อบังคับ สนธิสัญญา มาตรฐาน หรือคู่มือแนวทางปฏิบัติ ระหว่างประเทศ ซึ่งประเทศไทยไม่ได้เป็นภาคี หรือ ไม่ได้ มีการนำมา อนุวัติการ เป็นกฎหมาย ไทย ทั้งนี้ กรมเจ้าท่า มี สิทธิ์ เด็ดขาด ในการ กำหนดข้อ ยกเว้น ในตราสารที่ใช้บังคับได้ 5.2 .6 เพื่อความโปร่งใส องค์กรหรือบุคคลภายนอก ซึ่งเป็นบุคคลที่สามในการตรวจประเมินและรับรอง ระบบต้องเป็นหน่วยงานอิสระ และไม่มีนิติสัมพันธ์ใด ๆ เกี่ยวข้องกับกลุ่มตรวจประเมินขององค์กรสถาบันจัดชั้นเรือ ระหว่างประเทศ ( International Association of Classification Societie s: IACS) เพื่อเป็นการรักษาผลประโยชน์ ของกรมเจ้าท่า ตัวอย่างเช่น ในกรณีระบบแผนงานรับรองคุณภาพ IACS ( Quality System Certification Scheme : QSCS ) คือ หน่วยรับรอง อิสระ ที่ได้รับการยอมรับอย่างเป็นทางการ ( independent Accredited Certification Body : ACB) ตามเกณฑ์ข้ อกำหนดของระบบบริหาร จัดการ คุณภาพ ( Quality Management System Requirement : QMSR) 5.2 .7 RO ต้องปฏิบัติตาม ข้อกาหนด ของ ระบบการ บริหารจัดการคุณภาพ ( QMSR ) เพื่อให้ได้รับการรับรอง โครงการ ระบบการ บริหารจัดการคุณภาพ ( Quality Management System Certification Scheme: QSCS) จาก หน่วยงานหรือบุคคล ภายนอก ซึ่ง ได้ ให้บริการตรวจประเมินและรับรองระบบ 5.2 .8 กรมเจ้าท่า มี สิทธิ เด็ดขาด ในการตีความตำม ตราสารที่ใช้บังคับ รวมถึง พิจารณากำ หนด สิ่ง ที่ สามารถใช้ เทียบเคียง หรือ ยอมรับสิ่งที่ สามารถใช้ ทดแทนกันได้ โดยเป็นไปตาม ข้อกำ หนด ตาม ตราสารที่ใช้บังคับ ทั้งนี้ RO ต้อง ให้ความร่วมมือเพื่อ ปฏิบัติตามแนวทางหรือข้อกำหนด ดังกล่าว ด้วย

5 . Legal principles of performance under authorization. 5.1 This Agreement is established under section 163/1 of the Navigation in the Thai Water s Act B.E 2456 , as amend ed , together with t he Ministry of Transport Notification on C riteria, P rocess and condition for A uthorizing S hip I nspection I nstitute to C onduct S urvey and I ssue certificates on B ehalf of Marine Department . In addition, it was considered in accordance with the requirement of RO Code, and other requirement s of Marine Department. 5.2 Interpretation of Applicable Instrument In the event any arguments or disputes arise on the term and condition of the Memorandum of Agreement , such term and condition shall be solely referred to and interpreted by the Marine Department and its judg e ment shall be final. 5.2.1 In this Agreement, “inspection” shall also include “survey” as a common ter m use in maritime industrial. 5.2.2 In this Agreement, “statutory” shall have t he same meaning to the term generally use in various IMO’s document s . 5.2.3 In this Agreement, “Type Approval or Approval ” shall have t he same meaning to the term generally use in various IMO’s document s . 5.2.4 In this Agreement, “service supplier” is a n entity or natural person wh o provides services on behalf of RO such as a measurement, testing or maintenance which the results are factors for consideration of certificate issuance. 5.2.5 In this Agreement, document, statement or certificate of compliance including document of compliance which shows the compliance with Non - contracting Conventions or Codes or Treaties, or Standards or Guidelines which are not implement ed in to Thai legislation. It is the prerogative of the M arine D epartment to exempt requirements in applicable instruments. 5.2.6 For transparency, the entity or personnel, which is a third party for audit and approv e the system, shall be an independent unit and non - interrelation with International Association of Classification Societies (IACS) audit group effectively representing the interests of the Marine Department, such as, with respect to the IACS Quality System Certification Scheme (QSCS), an independent Accredited Certification Body (ACB), as required in the Quality Management System Requirement (QMSR) 5.2.7 RO shall comply with QMSR to obtain Quality Management System Certification Scheme (QSCS) from the third party who provide s audit and approve s the system. 5.2.8 It is the prerogative of Marine Department to interpret the applicable instruments as well as to determine an equivalent or acceptance of substitutes to the requirements of the applicable instruments. RO shall cooperat e to follow such interpretation or determin ation .

5.3 ข้อยกเว้นและกำรเทียบเคียง 5.3.1 กรมเจ้าท่า เท่านั้นที่มีหน้าที่ อานาจ ในการพิจารณากาหนด ข้อยกเว้น ภายใต้ ตราสารที่ใช้บังคับตาม ข้อกาหนดในสนธิสัญญาและอนุสัญญา โดย RO ยอมรับว่าไม่ได้รับมอบหมายให้ทาการ พิจารณากาหนด ข้อ ยกเว้นได้ ไม่ว่าจะเป็นการ ออกใบสาคัญรับรองเพื่อการยกเว้น หรือทาการยกเว้นข้อกาหนด ในการ ดําเนินกํารตรวจเรือและ ออกใบส ําคัญรับรอง ตามกฎหมาย ซึ่งได้มีการปฏิบัติตามข้อตกลงฉบับนี้ เว้นแต่ เป็น ข้อ ยกเว้นซึ่ง RO ได้รับ มอบหมายตามที่ปรากฏในตารางในภาคผนวก 1 ของข้อตกลงฉบับนี้ 5.3.2 เจ้าของเรือต้องแจ้ง RO ถึงสาเหตุพร้อมทั้งการประเมินความเสี่ยงและข้อเสนอสาหรับมาตรการ รองรับความเสี่ยง เพื่อขอ ข้อ แนะนำสาหรับมาตรการรองรับในการดาเนินการ ตาม ข้อยกเว้น หรือ การยอมรับ ข้อยกเว้น ต่อ กฎ ระเบียบ ข้อบังคับ หรือตราสาร ที่ใช้บังคับ ทั้งนี้ เมื่อ RO ได้ พิจารณา พร้อม ให้ความเห็น ใน เชิง เสนอแนะ เ ป็นลายลักษณ์อักษร แล้ว ให้ดำเนินการ ส่งให้กรมเจ้าท่าเพื่อพิจารณาว่า สมควร อนุญาตให้ได้รับการ ยกเว้น หรือยอมรับ เป็นข้อยกเว้นหรือไม่ 5.3.3 กรณีไม่อาจจัดหาสิ่งทดแทน ซึ่ง เป็นไปตามข้อกา หนด ตาม ตราสารที่ใช้บังคับได้ เจ้าหน้าที่ตรวจเรือ ของ RO อาจยอมรับ มาตรการชั่วคราว ตามคาแนะนาของกรมเจ้าท่า ให้ใช้อุปกรณ์ทดแทนอื่นเพื่อยอมให้เรือ สามารถแล่นไปยังเมืองท่าถัดไปที่ซึ่งสามารถทาการซ่อมแซมถาวร แก้ไขข้อชารุดบกพร่องต่าง ๆ หรือเปลี่ยนแปลง อุปกรณ์ใหม่ให้เป็นไปอย่างเหมาะสมได้ 6 . RO ต้องรายงาน ข้อมูล ให้กรมเจ้าท่าทราบ ตาม ขั้นตอนวิธีการ ดังนี้ 6.1 RO ต้อง ปฏิบัติตามขั้นตอนการรายงานการมอบหมายแบบทั่วไปและการมอบหมายแบบพิเศษ รวมถึง รายงาน แบบ อื่น ๆ ตามตาราง ในภาคผนวก 2 ของข้อตกลงฉบับนี้ 6.2 การรายงาน ข้อมูล ให้จัดทาเป็นจดหมายหรือจดหมายอิเล็กทรอนิกส์ หรือรูปแบบไฟล์เอกสารใน ฐานข้อมูลหรือ แอปพลิเคชัน ที่กรมเจ้าท่าสามารถเข้าถึง ได้

5.3 Exemption and Equivalent 5.3.1 Exemption from requirements of treaty and convention, states in the applicable I nstrument , it is accredited only Marine Department . RO accept that it is not authorized to exempt, issue exemption certificate or exempt the requirements of the Statutory Certification and Services performing under this Agreement. Except, RO has been authorized in accordance of table in Annex I 5.3.2 Exemption and Exempted Acceptance of the regulations or applicable requirements, the S hipowner shall inform reasonable cause(s) with risk assessment and initial preventive measures to RO for advice in the preventive measures of that exemption and exempted acceptance . Then RO provide s a suggestive decision in its formal writing form to Marine Department for the Exemption and Exempted Acceptance. 5.3.3 In event of unable to arrange the Equivalent as required in applicable instrument. The RO’s ship surveyor may accept, under Marine Department advice, control measures to temporarily use substitute equipment to allow ship sailing to the next port where ava ilable to permanently repair, rectify or renew the suitable equipment. 6 . RO shall report back to Marine Department as followed: 6.1 Procedures of reporting of general and special authorizations, and other reports as table in Annex II 6. 2 The report shall be submitted via mail or email or file document in database or application accessible by Marine Department.

7. การ จัดทำ กฎ ระเบียบ และ/หรือ ข้อบังคับ ข้อมูลข่าวสาร และ การให้ ความร่วมมือ 7.1 การให้ ความร่วมมือเกี่ยวกับการ จัดทำ กฎ ระเบียบ และ/หรือ ข้อบังคับ – การ ติดต่อ ประสานงาน 7.1.1 RO และกรมเจ้าท่า ตระหนักถึงความสาคัญของการให้ความร่วมมือ ระหว่าง กันทางด้านเทคนิค โดยตกลงให้ความร่วมมือและรักษาระดับความร่วมมือของคณะ ทางาน ด้านการให้คาปรึกษา ที่ ได้รับเลือกให้เป็นไป อย่างมีประสิทธิภาพ ทั้งนี้ คณะ ทางาน ดังกล่าว ประกอบด้วย เจ้าหน้าที่ กรมเจ้าท่าและ RO ซึ่ง ได้รับมอบหมาย สำหรับการปฏิบัติการออกใบสาคัญรับรองและให้บริการตามกฎหมาย ซึ่งได้ ตกลงร่วมกันเป็นลายลักษณ์อักษร 7.1.2 ที่ประชุมคณะ ทำงาน ด้านการให้คำปรึกษา ต้องจัด ให้มีการ ประชุม ตามกาหนดเวลา อย่าง สม่ำเสมอ 7.1.3 กรมเจ้าท่าต้องจัดให้มีเอกสารที่จาเป็นสาหรับ RO เพื่อ ให้ RO สามารถเข้าถึงข้อมูลกฎ ระเบียบ และข้อบังคับ ต่างๆ ที่เกี่ยวข้องกับการ ดําเนินกํารตรวจเรือและออกใบสําคัญรับรอง ตามกฎหมายที่ได้รับมอบหมาย โดย ไม่มี ค่าใช้จ่าย 7.1.4 RO ต้องทาให้แน่ใจว่ากรมเจ้าท่าสามารถเข้าถึงข้อมูล เอกสาร และไฟล์เอกสาร รวมถึงรายงาน การตรวจเรือซึ่ง RO ได้ ออก รับรอง หรืออนุมัติใบสำคัญรับรองให้แก่เรือที่จดทะเบียน เป็นเรือ ไทย ทั้ งนี้ กรณีจำเป็น ซึ่งเรืออาจอยู่ในอันตราย หรือส่งผลให้เกิดอันตรายหรือเกิดความเสียหายแก่ชีวิต สุขภาพ อนามัย สิ่งแวดล้อม ทรัพย์สิน หรือทรัพยากร กรมเจ้าท่า ขอสงวนสิทธิ์ในการ ร้องขอข้อมูลแบบแปลนเรือเพิ่มเติมได้ 7.1.5 การให้ความร่วมมือกับผู้แทน/ตัวแทน ของ กรมเจ้าท่าในการเข้าร่วมประชุมสัมมนา ภายในประเทศ หรือ ระหว่างประเทศ RO ตกลงให้การสนับสนุนกรมเจ้าท่าสาหรับการจัดเตรียมเอกสาร ข้อ แนะนาทางด้านเทคนิค โดยปราศจากค่าใช้จ่าย ให้กับผู้แทน/ตัวแทน ของ กรมเจ้าท่า ไม่ว่าจะเป็นการประชุมสัมมนาภายในประเทศหรือ ระหว่างประเทศ หรือคณะกรรมาธิการ อนุกรรมาธิการ คณะทางาน ต่างๆ ที่เกี่ยว ข้องด้านความปลอดภัย ทางทะเล การรักษาความมั่นคงปลอดภัย ทางทะเล หรือการป้องกันมลภาวะทางทะเล รวมถึง ประเด็นทางเทคนิคอื่นใด

7 . Development of R ules and/or R egulations, Information and C ooperation. 7.1 Cooperation in connection with D evelopment of R ules and/or R egulations – L iaison M eetings. 7.1.1 RO and Marine Department are aware of the importance of technical cooperation by agree to cooperate and maintain effective cooperation of the consultative working group . The working group is comprise d of Marine Department and Authorized RO officers performing the Statutory Certification and Services under written agreement. 7.1.2 The meeting of the consultative working group shall be regularly and continuously carried out. 7.1.3 Marine Department shall arrange, free of charge, all necessary documents for RO to ensure that RO is accessible to all regulations regarding to the authorized Statutory Certification and Services. 7.1.4 RO shall ensure that Marine Department is accessible to all ship’s documentations and electronic file including ship survey reports which RO has issued, certified or approved to ships registered to Thai flag. Marine Department shall reserve its rights to request ship’s plan and relevant inform ation in case that ships may be in danger or may impair or damage human life or health, environment, property or resources. 7.1.5 Cooperation with Marine Department delegate/representative in the national/ international conference, RO agrees to support Marine Department for providing technical advice documents, free of charge, to Marine Department delegate/representative in the national/international conference, or committee, sub - committee, working group in connecting with maritime safety, security or po llution prevention, and further technical issues.

7. 2 การแลกเปลี่ยน กฎเกณฑ์ คู่มือแนวทางการปฏิบัติ และ/หรือ กฎ ระเบียบ ข้อบังคับ รวม ทั้ง ข้อมูล ข่าวสาร 7 . 2 .1 RO ต้อง จัด ส่ง กฎเกณฑ์ และ คู่มือแนวทางปฏิบัติ ฉบับที่เป็นปัจจุบัน สำหรับเรือทุกประเภทซึ่งได้มีการ จดทะเบียนเป็นเรือไทย ( Class Rules ) ให้ แก่ กรมเจ้าท่า เก็บรักษาไว้ อย่างน้อย 1 ชุด โดยไม่ เสีย ค่าใช้จ่าย ทั้งนี้ อาจ จัดทำขึ้นใน รูปแบบ ของข้อมูล อิเล็กทรอนิกส์ หรือ ในรูปแบบ อื่น ๆ 7. 2 .2 กรมเจ้าท่าต้องสามารถเข้าถึงบริการของ RO ได้โดยไม่ เสีย ค่าใช้จ่าย ไม่ว่าจะเป็น ข้อมูลเรือที่ จด ทะเบียนในระบบ RO เอกสารต่าง ๆ รายงานการตรวจเรือ การตรวจสภาพ และตรวจประเมินสถานีบริการ รวมถึง การตรวจสภาพตามใบสาคัญรับรองซึ่งได้รับการอนุมัติหรือสลักหลังรับรองโดย RO ผ่านระบบออนไลน์ 7. 2 .3 RO ตกลงให้ความร่วมมือกับกรมเจ้าท่า สาหรับ การฝึกอบรมเจ้าหน้าที่ของกรมเจ้าท่าตาม ที่ได้ ตกลง ร่วม กัน 7. 2.4 เมื่อ RO ได้ ปรับปรุงกฎเกณฑ์หรือคู่มือแนวทาง การ ปฏิบัติใหม่ หรือเปลี่ยนแปลงกฎเกณฑ์และคู่มือ แนวทาง การ ปฏิบัติ ซึ่งเกี่ยวกับ ข้อกาหนดในการตรวจเรือซึ่งใช้บังคับอยู่ หรือการให้การรับรองตามกฎหมาย ให้ สอดคล้องกับตราสารที่ใช้บังคับ รวมถึงติดตามตรวจสอบและประเมินผลการดาเนินการตามข้อตกลงฉบับนี้ RO ต้องจัดให้กรมเจ้าท่ามีโอกาสให้ความเห็นหรือข้อเสนอแนะต่อกฎเกณฑ์หรือคู่มือแนวทางปฏิบัติใหม่หรือการแก้ไข เพิ่มเติม และนาความเห็นหรือข้อ เสนอแนะนั้นไปพิจารณาเปลี่ยนแปลงหรือปรับปรุงกฎเกณฑ์และคู่มือแนวทาง ปฏิบัติดังกล่าว 7. 2.5 กรมเจ้าท่าและ RO ตกลง ให้มีการ แลกเปลี่ยนข้อมูลร ะหว่าง กัน ตามรูปแบบที่กาหนด อย่างสม่าเสมอ เพื่อให้กรมเจ้าท่าและ RO สามารถตรวจสอบความถูกต้องของบันทึก ข้อมูล ที่เกี่ยวข้องกับบริษัทและเรือได้ 7. 2.6 RO ตกลงให้เจ้าพนักงานตรวจเรือของกรมเจ้าท่า สามารถ เข้าร่วม การ ตรวจเรือ ไทย ของ RO ซึ่ง ได้ กำหนด ร่วมกัน ให้ มี ขึ้นได้

7.2 Exchange of rules and/or regulations and information 7.2.1 RO shall provide, free of charge, to Marine Department at least 1 set of the updated RO’ s Rules (also called Class Rules) and guideli nes of all ship types which registered to Thai flag, in electronic file or the other forms. 7.2.2 Marine Department shall be accessible, free of charge, to services, online ship registration in RO system, documents, ship survey reports, service station inspections and audits, and inspections according to certification, approval or endorsement from RO. 7.2.3 RO agrees to cooperate with the Marine Department in training personnel of the Marine Department as mutually agreed. 7.2.4 When RO develops new rules and guidelines, or changes the existence which relevant to ship survey requirement, Statutory Certificati on in compliance with applicable instruments including monitoring and assessment the compliance of this Agreement, RO shall provide opportunity to Marine Department to make comment or recommendation in new rules and guidelines or the amendment, and take the comment or recommendation into the change or improvement of the abovementioned rules and guideline. 7.2.5 Marine Department and RO agree to regularly exchange data in mutually agreed form that allows Marine Depar tment and RO to be able to examine a correction of records regarding to companies and ships. 7.2.6 RO agrees to allow the surveyors of the Marine Department to join RO in the surveys on Thai vessels which shall be mutually determined.

7.3 ภาษาและรูปแบบที่ใช้ ข้อมูลและเอกสารกฎ ระเบียบ และ/หรือ ข้อบังคับทุกประการ – ข้อมูลข่าวสารที่ RO จัดส่งให้กรมเจ้าท่า ให้ทำ เป็นภาษาอังกฤษ หากเป็น ภาษาอื่น ให้ แปล ให้ เป็นภาษาอังกฤษ 7.3.1 ฐานข้อมูลอิเล็กทรอนิกส์ RO ต้องเก็บรักษาฐานข้อมูลอิเล็กทรอนิกส์ สาหรับ การตรวจเรือและการอนุมัติที่เกี่ยวข้องกับ การ ให้การ รับรอง สถานะของผลการตรวจประเมิน ที่เกี่ยวกับ ดําเนินกํารตรวจเรือและออกใบส ําคัญรับรอง ตามกฎหมาย ซึ่งได้รับมอบหมายตาม ข้อตกลงฉบับนี้ ทั้งนี้ RO ต้องทำให้แน่ใจว่ากรมเจ้าท่าสามารถเข้าถึงข้อมูลข่าวสารข้างต้นได้ โดยไม่ เสีย ค่าใช้จ่าย

7.3 Language and Form All data and documentation of rules and/or regulations – information, provided to Marine Department by RO, shall be in English, and translated into English if not. 7.3.1 Electronics database RO shall maintain electronics database of Statutory Survey and approval Audit Status regarding to Statutory Certification and Services which authorized in this Agreement. RO shall ensure that information abovementioned is accessible , free of charge, to Marine Department .

8. เงื่อนไขอื่นๆ 8.1 กฎเกณฑ์ในการดำเนินกา รพิจารณา อุทธรณ์ 8 . 1 . 1 คา ขอ ให้ดาเนินการ พิจารณา อุทธรณ์ ระหว่างเจ้าของเรือและ RO ที่เกี่ยวข้องกับ การ ดําเนินกําร ตรวจเรือและออกใบส ําคัญรับรอง ตามกฎหมาย หรือการต่อเรือใหม่ โดยมีวัตถุประสงค์เพื่อ ขอ จดทะเบียน กับ ก รมเจ้าท่า (ถือใบรับรองการจดทะเบียนเรือโดยมีวัตถุประสงค์เพื่อต่อสร้างเรือใหม่ในขณะที่เรืออยู่ระหว่างการ ต่อสร้าง ณ อู่ต่อเรือของผู้ต่อสร้างเรือ) ให้ RO ดาเนินการ โดยใช้ กระบวนการพิจารณา อุทธรณ์ ทั้งนี้ RO ต้องจัดส่ง สำเนา เอกสาร การ ดำเนินการ พิจารณา อุทธรณ์ 1 ฉบับ ให้แก่กรมเจ้าท่า ทราบ ด้วยโดยไม่ เสีย ค่าใช้จ่าย 8. 1 .2 RO ต้อง รายงาน การดาเนินการ พิจารณา อุทธรณ์ ทั้งหมดให้ แก่ กรมเจ้าท่าทราบ ทั้งนี้ ให้เป็นไป อย่าง สอดคล้องกับข้อกำหนดของ ข้อตกลงฉบับนี้ 8. 1 .3 RO ต้องแจ้งสถานะ การดาเนิน การ พิจารณาอุทธรณ์ ให้ แก่กรมเจ้าท่า ทราบ และอนุญาตให้กรม เจ้าท่าสามารถดำเนินการกรอกหรือเพิ่มเติมข้อมูลได้ตามที่เห็นสมควร 8. 1 .4 RO ต้องแจ้งผลการ พิจารณาอุทธรณ์ ทุก รายการ และ การสิ้นสุด กำรดาเนิน การ พิจารณาอุทธรณ์ ให้ แก่ กรมเจ้าท่าทราบ 8 . 1 . 5 กรณี มีข้อขัดข้องหรือไม่สามารถหาข้อยุติได้จาก กำรดาเนิน การ พิจารณาอุทธรณ์ ภายในของ RO ให้ เป็น ดุลยพินิจ ของ กรมเจ้าท่าในการ พิจารณาอุทธรณ์ ให้เป็นไปโดยสอดคล้องกับกฎหมายภายในประเทศ 8. 2 การเก็บรักษาความลับ ให้ เป็นไปโดยสอดคล้องกับ เอกสารใน ภาคผนวก 3 ของ ข้อตกลงฉบับนี้ 8. 3 ความรับผิด 8. 3 .1 หากไม่ เป็นการกระทบกระเทือน ถึง ความคุ้มกัน ของ รัฐไทย ซึ่งมีอานาจอธิปไตย เด็ดขาด และ หน่วยงาน ตามรัฐธรรมนูญ รวมถึง กรมเจ้าท่า เจ้าหน้าที่ ตัวแทน และ/หรือ หน่วยงาน ภายในซึ่งอยู่ภายใต้สังกัด ตลอดจน หน่วยงาน ซึ่ง อยู่ภายใต้การ ควบคุมหรือ กากับดูแล พร้อมด้วย เจ้าหน้าที่ หรือตัวแทน ไม่ว่าจะเป็นการตัดสิน ชี้ขาดโดยกระบวนการทางศาล รวมทั้ง การดาเนินการให้ เป็นไปตาม ข้อกาหนดให้ ชดใช้เยียวยาค่าเสียหาย สำหรับ ความ สูญ หาย เสียหายต่อทรัพย์สิน การ บาดเจ็บ ต่อร่างกาย หรือ การ สูญ เสียชีวิต ให้แก่ผู้ ที่ ได้รับความ เสียหาย ซึ่ง ได้ รับ การ พิสูจน์แล้วว่า เหตุ ดังกล่าว เกิดจากการกระทาโดยจงใจ งด เ ว้น หรือประมาทเลินเล่ออย่างร้ายแรงของ RO หน่วยงานภายในองค์กร เจ้าหน้าที่ ลูกจ้าง ตัวแทน หรือบุคคลอื่น ใดซึ่งกระทา การในนามของ RO ภายใต้ข้อตกลง ฉบับ นี้ กรมเจ้าท่า พร้อมด้วย เจ้าหน้าที่ และ ตัวแทน และ หน่วยงานภายในซึ่งอยู่ภายใต้สังกัด รวมถึงหน่วยงานที่อยู่ ภายใต้การควบคุมหรือกากับดูแล พร้อมด้วย เจ้าหน้าที่ และตัวแทน ต้อง มีสิทธิได้รับการชดใช้ เยียวยาค่าเสียหาย ไม่ว่า จะเป็น ความ สูญ หาย เสียหายต่อทรัพย์สิน การ บาดเจ็บ ต่อร่างกาย หรือ การ สูญ เสียชีวิต (รวมถึงค่าใช้จ่ายทาง กฎหมายทุ กประการ ) ซึ่ง ได้รับการพิจารณาแล้วว่ามี สาเหตุจาก RO หน่วยงาน ภายในองค์กร เจ้าหน้าที่ ลูกจ้าง ตัวแทน หรือ บุคคล อื่น ใดซึ่งกระทา การในนามของ RO ภายใต้ข้อตกลง ฉบับ นี้ ทั้งนี้ ต้องเป็นไป โดยสอดคล้องกับ บททบัญญัติของ กฎหมายไทย และ อยู่ ภายใต้เขตอานาจ ของ ศาลไทย ด้วย

9. Other conditions. 8.1 Rules for administrative proceedings 8. 1 .1 Appealing in connection with Statutory Certification and Services or newbuilding intended to be registered with Marine Department (holding the registration certificate intended to build new ship during the construction at the shipbuilder’s shipyard) shall be handled by RO through the appeals process. One (1) copy of the appealing process of RO document shall be given, free of charge , to Marine Department . 8. 1 . 2 RO shall report all appeals to Marine Department in accordance with requirements in this Agreement. 8. 1 .3 RO shall inform the appeal status to Marine Department , and grant Marine Department to make input as appropriate. 8. 1 . 4 RO shall inform all decisions of appeal and case - clos ure to Marine Department . 8. 1 .5 If there is any dispute or the appeal is unable to be settled within the RO’s appeal process, in this case, the decision is under the discretion of Marine Department and Thai legislation. 8. 2 Confidentiality to the Agreement shall be in accordance with Annex III of this Agreement. 8 . 3 Liability 8. 3 .1 If, notwithstanding the sovereign immunity of Thailand and its constituent agencies, including the Marine Department , its employees or agents, and any and/or all of its branches, subsidiaries, and affiliates, and their employees or agents, by a court of law , together with a requirement to compensate the injured parties for loss or damage to property or personal injury or death, which is proved to have been caused by a willful act or omission or gross negligence of the RO, its bodies, officers, employees, agents, or others who act on behalf of the RO under this Agreement, Marine Department , its employees or agents, and any and/or all of its branches, subsidiaries, and affiliates, and their employees or agents, shall be entitled to indemnification from the RO to the extent that such loss or damage to property, personal injury, or death (including all legal costs) is determine d to be caused by the RO, its bodies, officers, employees, agents, or others who act on behalf of the RO under this Agreement, shall be in accordance with Thai law a nd under the jurisdiction of the Thai court.

8 . 4 การทำประกันภัยหรือวางหลักประกันทางการเงิน และความรับผิดของ RO 8 . 4 . 1 เพื่อให้กํารด ําเนินกํารเป็นไป ตําม ข้อ 5 (3) ของ ประกาศกระทรวงคมนาคม เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไข ในการประกาศกาหนดสถาบันการตรวจเรือ ให้ตรวจเรือและออกใบสาคัญรับรองการตรวจเรือจาก กรมเจ้าท่ำ RO ต้อง จัดให้ มี กํารท ําประกันภัยหรือวํางหลักประกันทํางกํารเงิน ให้ครอบคลุม ควํามเสี่ยงภัย ดังนี้ 1) จัดให้มีกํารทําประกันภัย ควํามรับผิดจํากกํารปฏิบัติหน้ําที่ตํามกฎหมําย สาหรับการบาดเจ็บต่อร่างกาย หรือการสูญเสียชีวิต ให้แก่ผู้ ที่ ได้รับความเสียหายซึ่งได้รับการพิสูจน์แล้วว่าเหตุดังกล่าวเกิดจากการกระทาโดยจงใจ งดเว้น หรือประมาทเลินเล่ออย่างร้ายแรงของ RO หน่วยงานภายในองค์กร เจ้าหน้าที่ ลูกจ้าง ตัวแทน หรือบุคคลอื่นใด ซึ่งกระทาการในนามของ RO ภายใต้ข้อตกลงฉบับนี้ ใ ห้มี วงเงิน โดย คํานวณ จําก วันที่ได้มีกํารวํางหลักประกัน โดย มี ควํามคุ้มครองขั้นต่ํา จํานวน อย่ํางน้อย 3.072 ล้ํานหน่วยสิทธิพิเศษ ถอนเงิน หรือวํางหลักประกันทํางกํารเงิน ให้มี มูลค่ําของหลักประกัน ที่สํามํารถครอบคลุมควํามเสี่ยง ได้ ในจ ํานวนเดียวกัน 2 ) จัดให้มี กํารท ําประกันภัยควํามรับผิดจํากกํารปฏิบัติหน้ําที่ตํามกฎหมําย ส ําหรับ กําร สู ญหําย หรือเสียหําย ต่อ ทรัพย์สิ น ให้แก่ผู้ ที่ ได้รับความเสียหายซึ่งได้รับการพิสูจน์แล้วว่าเหตุดังกล่าวเกิดจากการกระทาโดยจงใจ งดเว้น หรือประมาทเลินเล่ออย่างร้ายแรงของ RO หน่วยงานภายในองค์กร เจ้าหน้าที่ ลูกจ้าง ตัวแทน หรือบุคคลอื่นใดซึ่ง กระทาการในนามของ RO ภายใต้ข้อตกลงฉบับนี้ ให้มีวงเงิน ตํามหน่วยสิทธิพิเศษถอนเงิน ของข้อ 8.4.1 (1) โดย ควํามคุ้มครองขั้นต่ําจํานวนอย่ํางน้อย 1.536 ล้ํานหน่วยสิทธิพิเศษถอนเงิน หรือวํางหลักประกันทํางกํารเงินให้มี มูลค่ําของหลักประกันที่สํามํารถครอบคลุมควํามเสี่ยง ได้ ในจ ํานวนเดียวกัน 8 . 4 . 2 หํากควํามรับผิดนั้นเกิดจํากอุบัติเหตุ อันเป็นเหตุ ให้ เกิดควําม สูญ หําย หรือเสียหําย ต่อ ทรัพย์สิน การบาดเจ็บต่อร่างกาย หรือการสูญเสียชีวิต ซึ่งศําลยุติธรรมไทยได้มีคําพิพํากษํา เป็นที่สุด แล้วว่ําเกิดขึ้นจํากกําร กระท ําโดยเจตนํา หรือ งด เว้นไม่กระท ํา กําร ของ RO หรือลูกจ้ําง หรือตัวแทน หรือผู้ที่กระท ําในนําม RO กรมเจ้ําท่ํา ต้องได้รับกําร เยียวยํา ชดใช้ ค่ ํา เสียหําย จําก RO ตําม มูลค่ํา ควํามสูญเสีย เสียหําย บําดเจ็บ หรือเสียชีวิต ที่ เกิดขึ้น จริง

8. 4 Insurance or f inancial g uarantees and l iability of RO 8.4.1 In accordance with section 5 ( 3 ) of the Ministry of Transport Notification on Criteria , Process and Condition for Authorizing Ship Inspection Institute to Conduct Survey and Issue Certificates on behalf of Marine Department , RO must provide insurance or place financial guarantees to cover the following risks: 1 ) Provide insurance for liability arising from the performance of duties under the law for bodily injury or loss of life t o those who suffer damages which is proved to have been caused by a willful act or omission or gross negligence of the RO, its bodies, o fficers, employees, agents, or others who act on behalf of the RO under this Agreement , there shall be a limit according to the Special Drawing Rights (SDRs) of clause 8.4.1 (1), with a minimum coverage of at least 3.072 million units of SDR s or place financial guarantees to have the value that can cover the same amount of risk. 2 ) P rovide insurance for liability arising from the performance of duties under the law for loss of or damage to property t o those who suffer damages which is proved t o have been caused by a willful act or omission or gross negligence of the RO, its bodies, officers, employees, agents, or others who act on behalf of the RO under this Agreement , there shall be a limit according to the Special Drawing Rights (SDRs) of c l ause 8.4.1 (1), with a minimum coverage of at least 1.536 million units of SDRs or place financial guarantees to have the value that can cover the same amount of risk. 8.4.2 If the liability is caused by an accident which causes loss or damage to property , bodily injury or loss of life which the Thai Court of Justice has given the final verdict that an accident was a willful act or omission from the act of RO or its employees or agents, or persons acting on behalf of RO, the Marine Department shall be inde mnified against RO on the actual amount of such loss, damage, injury or death .

8.5 ข้อรับรอง 8.5.1 RO รับรองว่ํา จะไม่มีกํารใช้เงิน หรือสิ่งของที่มีมูลค่ํา หรือผลประโยชน์อื่นใด เพื่อเสนอ หรือให้ สัญญํา หรือมอบให้ ไม่ว่ําโดยทํางตรงหรือทํางอ้อม โดย RO ให้แก่เจ้ําหน้ําที่ภําครัฐทั้งในประเทศและต่ํางประเทศ หรือบุคคลอื่น ตํามที่ได้มีกํารร้องขอ หรือกํารยินยอม หรือกํารนิ่งเฉย ซึ่งมีเจตนําที่จะเรียกรับหรือรักษําไว้ซึ่งธุรกิจ หรือผลประโยชน์ในกํารดําเนินธุรกิจ นอกจํากนี้ RO รับรองว่ําจะไม่มีกํารเสนอ หรือให้สัญญํา หรือปฏิบัติหน้ ําที่ อย่ํางไม่เหมําะสมตําม ข้อตกลงฉบับนี้ เพื่อเป็นกํารแลกเปลี่ยนกับกํารเรียกให้ชําระเงิน หรือสิ่งของที่มีมูลค่ํา หรือ ผลประโยชน์อื่นใด พร้อมกันนี้ RO จะไม่เสนอเงิน หรือสิ่งของที่มีมูลค่ํา หรือผลประโยชน์อื่นใด เพื่อเป็นกําร แลกเปลี่ยน หรือตอบแทนกับกํารปฏิบัติ หน้ําที่ อย่ํา งไม่เหมําะสมของบุคคล หรือองค์กรอื่นในท ํานองเดียวกัน 8.5.2 RO รับรองว่ํา จะด ําเนินกํารตรวจสอบวิเครําะห์กิจกําร ( Due Diligence ) ในกํารเลือกองค์กรและ บุคคลที่จะเข้ําร่วมกํารดําเนินกํารในนํามของตน ซึ่งองค์กรและบุคคลเหล่ํานั้นต้องให้กํารรับรองด้วยว่ํา ไม่เคยและ จะไม่มีกํารจ่ําย เส นอ มอบให้ ให้สัญญํา ได้รับ หรือได้รับกํารร้องขอไว้ ซึ่งตัวเงิน สิ่งของที่มีมูลค่ํา หรือผลประโยชน์ อื่นใด จํากองค์กร นํายหน้ํา ตัวแทน หรือลูกจ้ําง ไม่ว่ําโดยทํางตรงหรือทํางอ้อม เจ้ําหน้ําที่ หรือลูกจ้ํางของหน่วยงําน ภําครัฐหรือภําคเอกชน พรรคกํารเมือง หรือเจ้ําหน้ําที่พรรค หรือผู้ สมัครรับกํารเลือกตั้ง หรือผู้สมัครที่จะมีอิทธิพล ต่อกํารกระทําหรือกํารตัดสินใจใด ๆ เพื่อให้มีกํารเรียกรับหรือรักษําไว้ซึ่งธุรกิจ โดยตรงให้ฝ่ํายใดฝ่ํายหนึ่ง หรือท ําให้ ได้รับกํารปฏิบัติอย่ํางไม่เท่ําเทียม หรือท ําให้เกิดควํามได้เปรียบเสียเปรียบอย่ํางไม่เหมําะสม 8.6 การบอกเลิกและการบังคับใช้ข้อตกลง 8.6.1 ข้อตกลงฉบับนี้ อําจถูกบอกเลิกได้ระหว่ําง RO กับกรมเจ้ําท่ํา โดยฝ่ํายใดฝ่ํายหนึ่งอําจบอกกล่ําวขอ เลิก ข้อตกลงฉบับนี้ ให้อีกฝ่ํายทรําบเป็นลํายลักษณ์อักษรล่วงหน้ําไม่น้อยกว่ํา 12 เดือน ทั้งนี้ หนังสือบอกกล่ําวขอ เลิกข้อตกลงดังกล่ําวต้องจัดส่ งโดยไปรษณีย์ที่ได้มีกํารรับรองหรือลงทะเบียน 8.6.2 ข้อตกลงฉบับนี้ และข้อตกลงที่แก้ไขเพิ่มเติม รวมถึงภําคผนวก รวมกันมีผลเป็นข้อตกลงระหว่ําง คู่สัญญําทุกฝ่ํายและจะมีผลแทนที่ข้อตกลงอื่นก่อนหน้ํานี้ทั้งหมดระหว่ํางคู่สัญญําซึ่งมีประเด็นเป็นเรื่องเดียวกันและ เรื่องที่เกี่ ยวข้องกับ ข้อตกลงฉบับนี้ 8.7 การฝ่าฝืนเงื่อนไขตามข้อตกลง 8.7.1 หํากฝ่ํายหนึ่งฝ่ําฝืนเงื่อนไขตําม ข้อตกลงฉบับนี้ อีกฝ่ํายจะแจ้งให้อีกฝ่ํายทรําบถึงกํารกระทําที่เป็น กํารฝ่ําฝืนเป็นลํายลักษณ์อักษร เพื่อให้อีกฝ่ํายมีโอกําสปรับปรุงแก้ไขข้อบกพร่องภํายใน 30 วัน หํากไม่ดําเนินกําร ปรับปรุงแก้ไข ฝ่ํายที่แจ้ง ถึงกํารฝ่ําฝืน อําจบอกเลิก ข้อตกลงฉบับนี้ ได้ในทันที 8.7.2 ตลอดระยะเวลํา ที่ ข้อตกลงฉบับนี้ มีผลใช้บังคับ RO ต้องรักษําสถําน ภําพ ปัจจุบัน ที่เป็น สมําชิก ประเภท เต็ม รูปแบบขององค์กรสถําบันจัดชั้นเรือระหว่ํางประเทศ 8.7.3 ข้อตกลงฉบับนี้ อําจถูกบอกเลิกได้โดยฝ่ํายหนึ่งฝ่ํายใดโดยกํารบอกกล่ําวขอเลิก ข้อตกลงฉบับนี้ ให้ อีกฝ่ําย รับ ทรําบเป็นลํายลักษณ์อักษรล่วงหน้ํา เป็นระยะเวลํา ไม่น้อยกว่ํา 12 เดือน 8.8 กฎหมายที่มีผลใช้บังคับและการระงับข้อพิพาท ข้อโต้แย้งหรือข้อพิพําทอันเนื่องมําจําก ข้อตกลงฉบับนี้ ต้องด ําเนินกํารให้เป็นไปตําม บท กฎหมํายที่เกี่ยวข้อง กับ เขตอํานําจศําลยุติธรรมของประเทศไทย และเป็นไปโดยสอดคล้องกับ บท กฎหมํายภํายในของประเทศไทย

8.5 Warranties 8.5.1 The RO warrants that no payments of money or anything of value or any other advantage will be offered, promised, or given, directly or indirectly, by the RO to any domestic or foreign government official or to another person upon the offic ial’s request or with the official’s assent or acquiescence intending to obtain or retain business or an advantage in the conduct of business; further, the RO warrants that it will not offer to, promise to, or perform improperly any of its functions pursua nt to this Agreement in exchange for payment of money or anything of value or any other advantage, nor will it offer money or anything of value or any other advantage in exchange for, or as an award for, the improper performance of another individual or e ntity. 8.5.2 The RO warrants that it will exercise due diligence in the selection of entities and other individuals acting on its behalf and that they are all required to warrant that no funds, money or anything of value has been or will be paid, offered, given, promi sed, received or requested by them or any of their agents, representatives or employees, directly or indirectly, to or from any official or employee of any government – controlled entity or commercial entity, any political party or official thereof or any ca ndidate for political office, for purposes of influencing any act or decision in order to obtain or retain business, direct business to any party, obtain favorable treatment, or secure an improper advantage. 8.6 Termination and Enforceability 8.6.1 This A greement may be terminated as between the RO and Marine Department by either party giving the other party twelve (12) months written notice of termination. Such notice shall be given by certified or registered mail. 8.6.2 This Agreement, and any amendments hereto, including its Annexes, constitute the entire agreement between the parties and shall supersede all previous agreements between the parties hereto with respect to the subject matter hereof. 8.7 Breach of Agreement 8.7.1 If this Memorandum is breac hed by one of the parties, the other party will notify the violating party of its breach in writing to allow the notified party the opportunity to remedy the breach with 30 days, failing which the notifying party has the right to terminate this Memorandum immediately. 8.7.2 For continued validity of this Memorandum, RO shall maintain its present status of full membership of International Association of Classification Society. 8.7.3 This Memorandum may be terminated by either party by giving the other party a 12 - month written advance notice. 8.8 Governing Laws and Settlement of Disputes Any arguments or disputes arising out of or in connection with the Memorandum shall be governed by Court of Justice of Thailand and in accordance with the Laws of Thailand.

9 . การกำกับดูแลองค์กรที่ได้รับการยอมรับ ( RO) 9.1 การกำกับดูแลและการเฝ้าติดตาม RO RO ยอมรับว่ากรมเจ้าท่า สามารถ ดาเนินการให้มีโครงการกำกับดูแลและเฝ้าติดตามองค์กรที่ได้รับ มอบหมายให้ทำการรับรองและให้บริการได้ตามกฎหมายซึ่งกระทำ ลง ในนามของกรมเจ้าท่าให้เป็นไป โดย สอดคล้อง กับประมวลข้อบังคับว่าด้วยองค์กรที่ได้รับการยอมรับ ( RO Code) ทั้งนี้ RO ตกลงให้ความร่วมมืออย่างเต็มที่เพื่ อให้ กำรดำเนินการ กำกับดูแลและเฝ้าติดตามดังกล่าวเป็นไปตามที่กรมเจ้าท่า ได้ ร้องขอ 9.2 เอกสารและการตรวจสอบระบบการ บริหารจัดการคุณภาพ 9.2.1 RO ต้องคงไว้ซึ่งระบบการ บริหารจัดการคุณภาพ ภายในองค์กรที่มีประสิทธิภาพ โดยมี มาตร ฐาน ของระบบคุณภาพซึ่งเป็นที่ยอมรับในระดับสากลซึ่งไม่ด้อยกว่ามาตรฐานระบบ การ บริหารงานคุณภาพ ประเภท ไอเอสโอ 9000 ขององค์กรระหว่างประเทศว่าด้วย การ มาตรฐาน ( International Organization for Standardization: ISO 9000) 9.2.2 กรมเจ้าท่าอาจยอมรับผลการตรวจสอบที่กำหนดภายใต้โครงการระบบ การบริหารจัดการ คุณภาพ ( QSCS ) ขององค์ก รสถาบันจัดชั้นเรือ ระหว่างประเทศ ( International Association of Classification Societies; IACS ) ซึ่งมี การ ประเมิน ผลและ การให้ การรับรอง อย่างเป็นอิสระ ให้ เป็นวิธีการตรวจสอบการปฏิบัติตาม ( verification of compliance ) ที่ มีความ เหมาะสม ตาม ข้อกาหนดให้มี ระบบ การ บริหารจัดการคุณภาพ และ การ ตรว จประเมิน ที่เป็นอิสระ ตาม ประมวลข้อบังคับว่าด้วยองค์กรที่ได้รับการยอมรับ ( RO Code) และที่มีการแก้ไข เพิ่มเติม 9.2.3 RO ต้องยิ นยอม ให้ กรมเจ้าท่า สามารถ ทา การตรวจสอบระบบ การ บริหารจัดการคุณภาพ ของ องค์กร ให้เป็นไป ตามดุลยพินิจของ หน่วยงานภาครัฐ 9.2.4 กรมเจ้าท่า สามารถขอ เข้า ทาการ ตรวจสอบระบบ การ บริหาร จัดการคุณภาพ ของ RO ได้ ตาม รอบ ระยะเวลาที่กำหนดจนเป็นที่พอใจว่า RO ได้ปฏิบัติตามข้อกำหนดของ ข้อตกลงฉบับนี้ ประกอบกับเอกสารภาคผนวก 2 โดยมีรายละเอียดที่เกี่ยวข้องกับหน้าที่ในการตรวจสอบและการให้การรับรองของ RO ตามที่กรมเจ้าท่ากำหนดใน นามของกรมเจ้าท่า ในการนี้ ผู้แทนของกรมเจ้าท่าอาจเข้าร่วมการตรวจประเมินระบบคุณภาพดังกล่าวขององค์กร สถาบันจัดชั้นเรือระหว่ำงประเทศ ( International Association of Classification Societies; IACS) ได้ในฐานะ ของ ผู้สังเกตการณ์ 9.2.5 RO ต้องแจ้งให้กรมเจ้าท่าทราบทันทีในกรณีที่มีการยอมรับหรือการเปลี่ยนแปลงระบบ การ บริหาร จัดการคุณภาพ ซึ่งทำให้ใบรับรองระบบคุณภาพ ขาด ความสมบูรณ์ 9.2.6 RO ต้องแจ้งให้กรมเจ้าท่าทราบทันทีในกรณีเกิด ข้อบกพร่องร้ายแรงจากการตรวจประเมินของ หน่วยงานตรวจประเมินภายนอก ซึ่งถูกตรวจพบจากการตรวจประเมินการให้การ ออกใบสาคัญรับรอง และการ ให้บริการตามกฎหมายภายใต้ขอบเขตของ ข้อตกลงฉบับนี้

9. RO Oversight 9.1 Supervision and monitoring of RO The RO acknowledges that the Administrator has implemented an oversight and monitoring program of organizations authorized to conduct Statutory Certification and Services on its behalf in accordance with the RO Code. The RO agrees to fully cooperate with such oversight and monitoring activities as requested by Marine Department . 9.2 Documentation and Review of Quality Management System 9.2.1 The RO shall maintain an effective internal quality management system based on appropriate parts of internationally recognized quality standards no less effective than the ISO 9000 series. 9.2.2 Marine Department may accept the results of audits required under the IACS Quality System Certification Scheme (“QSCS”) which are independent assessment and cert ification as suitable verification of compliance with the quality management system and independent audit requirements of the RO Code, as amended. 9.2.3 RO shall accept Marine Department to review to its satisfaction with the quality management system of t he RO. 9.2.4 Marine Department shall itself be allowed the opportunity to review the RO’s quality management system on a periodic basis and to satisfy itself that the RO is in compliance with the requirements of this Agreement and its Annex II , specificati ons on the Survey and Certification Functions of RO acting on behalf of the Flag State, and the requirements of Marine Department . This may be accomplished by a representative of Marine Department participating as an observer in an IACS QSCS audit. 9.2.5 R O shall immediately notify Marine Department in the event that approval or change in the quality management system causes the quality system certificate to become invalid. 9.2.6 RO shall immediately inform Marine Department for m ajor non - conformity identified in audit of Statutory Certification and Services of the third party under scope of this Agreement.

9.3 การกำกับดูแลการตรวจสอบและการตรวจประเมิน ( Oversight of Inspections and Audits) 9.3.1 กรมเจ้าท่าจะทบทวนการปฏิบัติหน้าที่ซึ่งได้มอบหมายให้แก่ RO เพื่อให้มั่นใจว่าได้มีการ ดาเนินการไปอย่างมีประสิทธิภาพ โดยใช้วิธีการตรวจประเมินซึ่งอาจรวมถึงการใช้วิธีการตรวจ ติดตาม สัญญาใน รูปแบบ ตรวจประเมินโดยตรง ( Vertical Contract Audits) เช่น การสุ่มตรวจบันทึกทางเทคนิค กระบวนการ ทบทวน และ/หรือ การตรวจประเมินบริษัทและเรือตามที่กรมเจ้าท่าเห็นสมควร 9.4 การกักเรือโดยรัฐเจ้าของเมืองท่า ( Port State Control Detentions) 9.4.1 หากมีเหตุอันควรเชื่อหรือข้อบกพร่องที่ชัดเจนที่เกี่ยวข้องกับรายการอันเนื่องมา จากการตรวจให้ การรับรองและให้บริการตามกฎหมายภายในระยะเวลา 3 เดือน กรมเจ้าท่าจะทาการสอบสวนหาสาเหตุที่แท้จริง แห่งการกักเรือโดยให้ RO จัดทาและส่งรายงานสาเหตุที่แท้จริงแห่งการกักเรือ ทั้งนี้ มาตรการแก้ไขข้อบกพร่องนั้น ๆ ต้องได้รับการอนุมัติโดยกรมเจ้าท่าด้วย 9.5 การเข้าถึงข้อมูล ข่าวสาร (ข้อแนะนำ หนังสือเวียน และคู่มือแนวทางการปฏิบัติ) 9.5.1 RO ต้องจัดส่งสาเนาเอกสารขั้นตอนการปฏิบัติงาน คู่มือแนวทางการปฏิบัติ และ/หรือ วิธีการใน การดาเนินการและการปฏิบัติงานในการให้การรับรองและให้บริการตามกฎหมาย ฉบับที่เป็นปัจจุบั นและมีความ สมบูรณ์ พร้อมฉบับที่มีการแก้ไขที่เกี่ยวข้องกับการให้การรับรองและให้บริการตามกฎหมายภายใต้ข้อตกลงฉบับนี้ หรือจัดให้มีระบบอิเล็กทรอนิกส์ ซึ่งกรมเจ้าท่าอาจเข้าถึงข้อมูลเพื่อทาการตรวจสอบได้ ให้แก่กรมเจ้าท่าเมื่อมีการ ร้องขอ 9.5.2 RO ต้องจัดส่งรายงานประจำปีของงานที่ได้กระทำในนามของกรมเจ้าท่า หรือจัดให้มีระบบ อิเล็กทรอนิกส์ซึ่งกรมเจ้าท่าอาจเข้าถึงข้อมูลเพื่อ ทำการ ตรวจสอบได้ 9.5. 3 กรณี RO ได้เปลี่ยนแปลงขั้นตอนการปฏิบัติงานตามที่ได้ระบุไว้กับกรมเจ้าท่าเพื่อให้การ ดำเนินการเป็นไปตามข้อกาหนดใน ตราสารที่ใช้บังคับหรือตามนโยบายของกรมเจ้าท่า กรมเจ้าท่าอาจร้องขอให้ RO ปรับปรุงแก้ไข การดำเนินการ ซึ่งไม่สอดคล้องตามที่ได้รับมอบหมายให้กระทำในนามของกรมเจ้าท่าได้

9.3 Oversight of Inspections and Audits 9.3.1 Marine Department shall review the authorized RO duties to ensure that RO has efficient performance by conducting audit which may include vertical contract audit such as randomly check technical records, review and verification processes and/or audit of the company and shi p as Marine Department deems appropriate. 9.4 Port State Control Detentions 9.4.1 If a clear - ground/deficiency causing of detention related to the items covered by ship survey of Statutory Survey and Services within 3 (three) months, Marine Department shal l investigate a detention root - causes by RO root - causes report submission. Any corrective actions shall be approved from Marine Department . 9.5 Information accessibility (Recommendation, Circular and Guideline) 9.5.1 RO shall provide current and complete copies of written guidelines , procedures and/or instructions for implementation and performing Statutory Certification and Services including any amendments related to Statutory Certifications and Services under this agreement or provide electronic access to Marine Department upon request . 9.5.2 RO shall provide annual report of work on behalf of Marine Department or arrange the electronic access for granting Marine Department to examine 9.5. 3 In the event of RO has changed the procedures, specified by Marine Department , in order to conform to the applicable instruments or the policy of Marine Department , Marine Department may require the RO to correct any non - conformity affecting activities authorized on behalf of Marine Department .

9 .6 การฝึกอบรม 9 . 6 . 1 การฝึกอบรมและคุณสมบัติ 9 . 6 . 1 . 1 เจ้ําหน้ําที่ตรวจเรือ ผู้ตรวจสอบ และผู้ตรวจประเมินของ RO ซึ่งทําหน้ําที่ในกํารให้กํารรับรอง และให้บริกํารตํามกฎหมําย รวมถึงบุคลํากร ของ RO ซึ่ง ทําหน้ําที่เป็นผู้ช่วย ต้องมีคุณสมบัติสอดคล้องกับประมวล ข้อบังคับว่ําด้วยองค์กรที่ได้รับกํารยอมรั บ ( RO Code) 9 . 6 . 1 . 2 RO ต้องจัดให้มีระบบเอกสํารเพื่อยืนยันคุณสมบัติของเจ้ําหน้ําที่ตรวจเรือ ผู้ตรวจสอบ และ ผู้ตรวจประเมินของ RO ประกอบกับพัฒนําและปรับปรุงระบบดังกล่ําวอย่ํางต่อเนื่องเพื่อให้สอดคล้องกับมําตรฐําน ขององค์กรสถําบันจัดชั้นเรือระหว่ํางประเทศ ( International Association of Classification Societies: IACS) โดยระบบดังกล่ําวต้องประกอบด้วยหลักสูตรกํารฝึกอบรมที่เกี่ยวเนื่องกับกระบวนกํารออก ใบรับรอง และหลักสูตร กํารฝึกอบรมควบคู่กับกํารปฏิบัติจริง ทั้งนี้ RO ต้องสํามํารถแสดงเอกสํารหลักฐํานโดยมิชักช้ําเมื่อกรมเจ้ําท่ําร้องขอ 9 . 6 . 1 . 3 RO ต้องทําให้มั่นใจว่ําบุคลํากรที่เกี่ยวข้องกับกํารปฏิบัติกํารตํามหน้ําที่ที่ได้รับมอบหมํายภํายใต้ ข้อตกลงฉบับนี้ ได้ปฏิบัติกํารตํามหน้ําที่ให้เป็นไปตํามที่กําหนด อีกทั้ง RO ต้องทําให้มั่นใจว่ําบุคลํากรของตน รับทรําบและสํามํารถปฏิบัติกํารได้ถูกต้องตํามกฎหมํายและข้อบังคับต่ําง ๆ ที่มีผลใช้บังคับของกรมเจ้ําท่ํา รวมถึง ข้อแนะน ําต่ําง ๆ ซึ่งประกอบด้วย ก . หน้ําที่ตํามตรําสํารที่ซึ่งประเทศไทยเป็นภําคี โดยได้รับมอบหมํายจํากกรมเจ้ําท่ํา ข . กฎเกณฑ์ ค ําสั่ง ระเบียบ ข้อบังคับ และประกําศ ของกรมเจ้ําท่ํา ค . กฎหมํายแม่บทภํายในประเทศ ของกรมเจ้ําท่ํา ง . ข้อจ ํากัด ข้อแนะน ําพิเศษ รวมถึงข้อก ําหนดเพิ่มเติมใด ๆ ที่ระบุไว้ในข้อตกลง ฉบับ นี้ 9 . 6 . 2 การมีส่วนร่วมในโครงการฝึกอบรม กรมเจ้ําท่ําอําจเข้ําร่วมหรือก ํากับดูแลโครงกํารฝึกอบรมและกํารประเมินผล โดย ไม่มี ค่ําใช้จ่ําย เพื่อให้มั่นใจ ว่ํากํารฝึกอบรมเป็นไปอย่ํางมีระบบ และคุณสมบัติของบุคลํากร ที่เหมําะสมเป็นไป อย่ําง เสมอ ต้นเสมอปลําย

9.6 Training 9.6.1 Training and qualifications 9.6.1 .1 RO’s Ship Surveyor, Inspector and Auditor, performing Statutory Certification and Services and their assistants shall be qualified in accordance with RO Code. 9.6.1 .2 RO shall establish the documentation system for verification of the qualification of Ship Surveyor, Inspector and Auditor, and continually improve and update in accordance with International Association of Classification Societies Standard. The system shall consist of the appropriate training courses in connection with certification pr ocess, and on the job training courses. RO shall provide evidence, without delay, to Marine Department upon request. 9.6.1 .3 RO shall ensure that its personnel involving in the performance of their assigned duties under this Agreement are complied with the requirements in this section. RO shall ensure that its personnel acknowledge and comply with applicable laws and regulation s of Marine Department , and recommendation from Marine Department including: a. As authorized, the Applicable Instruments to which the Marine Department is a party; b. S tatutes of Marine Department ; c. Marine Department national regulations; d. Limitation, special recommendation and any additional requirements specify in this Agreement. 9.6.2 Participation in training program Marine Department may participate in or supervise, free of charge, the training programs and evaluation to ensure that the systematic training is conducted and appropriate qualifications of personnel are consistent.
