ประกาศกรมวิชาการเกษตร เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขการนำเข้าหรือนำผ่านซึ่งสิ่งต้องห้าม สิ่งกำกัด และสิ่งไม่ต้องห้าม พ.ศ. 2551 (ฉบับที่ 2) พ.ศ. 2565

ประกาศกรมวิชาการเกษตร เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขการนำเข้าหรือนำผ่าน ซึ่งสิ่งต้องห้าม สิ่งกากัด และสิ่งไม่ต้องห้าม พ.ศ. 2551 (ฉบับที่ 2 ) พ.ศ. 2565 โดยที่เป็นการสมควรแก้ไขเพิ่มเติมประกาศกรมวิชาการเกษตร เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขการนาเข้าหรือนาผ่าน ซึ่งสิ่งต้องห้าม สิ่งกำกัด และสิ่งไม่ต้องห้าม พ.ศ. 2551 เป็นการ แก้ไขเพิ่มเติมแบบคาขอใบอนุญาต ใบอนุญาต ใบแจ้งการนาเข้าหรือนาผ่าน และบั ตรกากับ เพื่อให้ สอดคล้องกับสถานการณ์ปัจจุบัน อาศัยอำนาจตามความในมาตรา 5 ฉ มาตรา 8 มาตรา 9 มาตรา 10 และมาตรา 11 แห่งพระราชบัญญัติกักพืช พ.ศ. 2507 ซึ่งแก้ไขเพิ่มเติมโดยพระราชบัญญัติกักพืช (ฉบับที่ 3) พ.ศ. 2551 อธิบดีกรมวิชาการเกษตร โดยคาแนะนาของคณะกรรมการกักพืช จึงออกประกาศไว้ ดังต่อไปนี้ ข้อ 1 ประกาศนี้เรียกว่า ประกาศกรมวิชาการเกษตร เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขการนาเข้าหรือนาผ่าน ซึ่งสิ่งต้องห้าม สิ่งกากัด และสิ่งไม่ต้องห้าม พ.ศ. 2551 (ฉบับที่ 2 ) พ.ศ. 2565 ข้ อ 2 ประกาศนี้ให้ใช้บังคับ เมื่อพ้นกำหนดสามสิบวันนับถัดจากวันประกาศในราชกิจจานุเบกษา เป็นต้นไป ข้อ 3 ให้ยกเลิกความในข้อ 1 แห่งประกาศกรมวิชาการเกษตร เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขการนาเข้าหรือนาผ่าน ซึ่งสิ่งต้องห้าม สิ่งกากัด และสิ่งไม่ต้องห้าม พ.ศ. 2551 และ ให้ใช้ ความต่อไปนี้แทน “ ข้อ 1 คาขอรับใบอนุญาต ใบอนุญาต ใบแจ้งการนาเข้าหรือนาผ่าน และบัตรกากับ บนภาชนะบรรจุสิ่งต้องห้าม สิ่งกากัด หรือสิ่งไม่ต้องห้าม ตามความในหมวด 1 ถึง 5 ให้เป็นไป ตามแบบแนบท้ายประกาศนี้ ” ข้อ 4 ผู้ใดประสงค์จะยื่นคาขอรับใบอนุญาต ใบแจ้งการนาเข้าหรือนาผ่านซึ่งสิ่งต้องห้าม สิ่งกากัด หรือสิ่งไม่ต้องห้าม ตามความในหมวด 1 ถึง 5 โดยวิธีการทางอิเล็กทรอนิกส์ ให้ปฏิบัติ ตามประกาศกรมวิชำการเกษตรว่าด้วยหลักเกณฑ์ วิธีการและเงื่อนไขการนาเข้า นาผ่านหรือนาเข้า เพื่อการส่งต่อซึ่งสิ่งต้องห้าม สิ่งกากัด และสิ่งไม่ต้องห้าม ตามพระราชบัญญัติกักพืช พ.ศ. 2507 และที่แก้ไขเพิ่มเติม โดยวิธีการทางอิเล็กทรอนิกส์ พ.ศ. 2559 ข้อ 5 บรรดาคาขอรับใบอนุญาต ใบอนุญาต ใบแจ้งการนาเข้าหรือนาผ่าน และบัตรกากับ ซึ่งได้ดาเนินการเสร็จสิ้นไปแล้วในวันก่อนวันที่ประกาศนี้ใช้บังคับ ให้มีผลใช้ได้ต่อไปจนกว่าจะครบอายุ หรือมีการดาเนินการใหม่ตามประกาศนี้ แล้วแต่กรณี ้ หนา 73 ่ เลม 139 ตอนพิเศษ 254 ง ราชกิจจานุเบกษา 26 ตุลาคม 2565

บรรดาการใดเกี่ยวกับการขอรับใบอนุญาต ใบอนุญาต ใบแจ้งการนาเข้าหรือนาผ่านและบัตรกากับ ที่อยู่ในระหว่างการดาเนินการและยังไม่แล้วเสร็จในวันก่อนวันที่ประกาศนี้มีผลใช้บังคับ ให้ดาเนินการ ตามประกาศกรมวิชาการเกษตร เรื่อง หลักเกณฑ์ วิธีการ และเงื่อนไขการนำเข้าหรือนาผ่าน ซึ่งสิ่งต้องห้าม สิ่ งกากัด และสิ่งไม่ต้องห้าม พ.ศ. 2551 ต่อไปจนกว่าจะแล้วเสร็จ ประกาศ ณ วันที่ 24 สิงหาคม พ.ศ. 25 6 5 ระพีภัทร์ จันทรศรีวงศ์ อธิบดีกรมวิชาการเกษตร ้ หนา 74 ่ เลม 139 ตอนพิเศษ 254 ง ราชกิจจานุเบกษา 26 ตุลาคม 2565
